Under the Freedom of Information Act please can you release the Police and Crime Commissioner’s itemised list of expenses claims for under £500 made between November 2012 and November 2013.

Searches were carried out within the Office of the Police and Crime Commissioner. The information you have requested is held by the Commissioner.

Decision

The Commissioner is committed to transparency, openness and honesty and all of her expenses and expenditure, regardless of value, are published on her website. The following link will give you access to the “Expenses and Expenditure” section of the website https://www.northyorkshire-pfcc.gov.uk/commissioner/finances/expenses/

You will need to access the following two pages via that link; “Commissioner’s mileage expenses” and “All Office of Police and Crime Commissioner expenses”. Between those two pages you will find all expenses and expenditure claims, regardless of value. Expenses for statutory and senior officers are also available on the North Yorkshire Police website, via the following link: https://northyorkshire.police.uk/about/finance/expenses/

Section 21 – Information reasonably accessible by other means

It has been decided that the Commissioner is exempt from providing you with a separate copy of the expenses pursuant to S21 of the Act. Section 21 is a class based absolute exemption which does not require consideration of the harm or public interest when applying this exemption.

This exemption applies as all the Commissioner’s expenses are published and can be viewed via the above link.

Section 17 of the Freedom of Information Act 2000 (the Act) requires the Commissioner when refusing to provide information because the information is exempt, to provide the applicant with a notice which: (a) states the fact, (b) specifies the exemption in question and (c) states (if it would not otherwise be apparent) why the exemption applies.

Pursuant to Section 17(1) Freedom of Information Act 2000, this letter acts as a refusal notice in relation to your request.
